Pulling Permits: Doing it Right if You’re DIY

Design Choices

We stood for what seemed like hours looking at the choices. There were various sizes, designs and materials to choose from. I knew what I wanted, but still once we got it and began cutting that was it. Will didn't quite see my vision and was concerned about the cuts.

We did finally choose base boards for our dining room. Then began the process of measuring, cutting, fitting, re-cutting and fitting again, painting, etc. It was a long process. We got better at cutting trim for corners, but this was our first experience, and of course, we went big with it.

It's about twice the height of most trim and I think it makes the room. I love the way it turned out. It was a labor of love, as was picking out the paint colors for each room of the house, changing the light fixtures out to match our style and breathing new life into an old, dark breezeway. That's the beauty of doing it yourself.

Doing-It-Yourself

We're generally do-it-yourself kind of folks. And that isn't because we're experts in home repair/remodeling, it's because I think we're industrious and resourceful enough {notice the stress on I. I always have to convince Will of this fact}; and we don't have the extra money to spend for someone else to do the work. That is, until it goes beyond our "expertise."

There are a few things we don't mess with. We have hired real experts to put in new windows, repair the heating and air systems and we do call the plumber when the problem is beyond our limited knowledge.

And yet, I am pretty proud of the work we've done in our house; mostly painting, adding trim and putting in new flooring and other things of that nature. Of course, this was all accomplished pre-kids and the house is now in sore need of a refreshing coat. We did take the first step and have sanded our doors and trim in an attempt to propel ourselves into this project, although that is the extent of the second round of the house re-do, so far.

We'll get around to it again....eventually.

We aren't alone in the DIY camp. As the economy crunches down on Middle America many homeowners opt to remodel instead of sell and buy again. A simple or complex re-do or new-do to your home can increase the worth of your home when you do sell or can make you, the homeowner, more content when it comes to living in this space that has either become a tight space for your family or just deteriorated with your day-to-day living.

Permits

But do you know when you should "pull a permit"? And do you realize that not knowing this could land you in a heap of trouble? Yep, you could end up owing a ton in fines or even wind up in court over failing to get permits for certain construction/remodel jobs in your home.

The good news is that it's simple to stay on the right side of the law. Here's what you need to know:

What Projects Require a Permit?

1. It's always a good idea to check with your municipality, but generally projects that involve structural changes, demolition, electrical or plumbing changes, etc. require a permit.
2. Often, large projects like a kitchen remodel and the like require more than 1 permit for the whole project.

Why Bother Getting a Permit?

1. If you don't get a permit and you get caught, you could pay a large fine; which will cost you much more than the original permit would have cost.
2. If you didn't get a permit/have an inspection {and should have} and later have a need to file an insurance claim regarding that work, they may not pay the claim.
3. Failure to get permits may even risk insurance coverage/rates.
4. You may have trouble with an inspection when/if you try to sell your home.

When Should the Permit be Obtained?

1. The first thing to do, before beginning the project, is to obtain a permit.
2. If a contractor is performing the work, it's probably best to have the contractor pull the permit; some cities even require that.
3. Be sure to properly display the permit while the work is being performed.
4. If work is started without a permit and the city notices this, all work will be halted until a permit is obtained, and a fine will be assessed.

The best rule of thumb? When in doubt, always check. In this case, it's better safe than sorry. Knowing this information and following the law will save you time and money down the road, especially if the work is not up to code when an inspector comes through when you're trying to sell.

In the Name of Safety

The purpose behind requiring permits is safety. If you have a permit, the work must be inspected by a city official when completed in order to close the permit. This requirement insures that the work was done correctly and is up to Code. If it wasn't, it can be fixed right away before causing damage, which could potentially harm the inhabitants of the home and perhaps even neighbors, etc.

The Scoop

If you choose to ignore your local government's code, you will be breaking the law; and in the end your project will cost you much more than you anticipated. It may seem like a hassle to have to "pull permits" and pay the permit fee(s) and have an inspector come, but in the long run, you'll be glad you did. Over and out...

The Lockout: Averting Catastrophe with an Emergency Kit & Some Chocolate

The Locked Door

Yesterday in my haste to get out the door with Darling 2 to pick up Darling 1 from school, I grabbed the garage door opener, left from a side door, locked it behind me and walk/ran the two blocks to the school. I needn't have rushed. The dismissal procedure was changed on Monday and then tweaked on Tuesday. What they failed to tell the parents is that the students are now leaving the building later too.

Darling 2 and I stood waiting and waiting until finally Darling 1 emerged from the school doors. We headed back home with plans of a snack and playing and a little Mommy time on the computer. As I hit the button on the garage door opener, I got a sinking feeling. I realized I had locked the door leading from the garage to the house when Darling 2 and I had come home earlier.

I tried the locked door anyway...and all the other doors too, but to no avail. I didn't have any keys for my house or my car. I did have my cell phone. I thought we'll just call Will. He'll come to our rescue.

Left Out in the Cold

Nope. I realized he had several meetings scheduled for the afternoon. That didn't stop me from calling and calling and calling, texting and tweeting him, hoping to catch him in between meeting. But there was no answer; I had the times of his meetings mixed up. The whole time I was trying to contact him his phone was in his computer bag with the ringer off.

Fortunately, it was nice weather and we had access to the outdoor toys in the garage. The boys happily played for the first hour of lockout. Then, the sun started falling lower and it started getting colder. Darling 2 and I hadn't even worn coats to pick up Darling 1. So, we retreated into the car in the garage. The boys rummaged through CDs and maps in the glove box, went through our first aid kit, tried on a few Band-Aids and pretended to drive. Then, we all three sat in the back bench, reclined as far as it would go and read from our stash of books that I keep in the car to occupy the boys.

Chocolate to the Rescue

By then, it has been an hour and a half, the boys were getting hungry. We went through Darling 1's lunch box and backpack and found a package of uneaten granola bars. Then, we hit the jackpot.

We found a large dark chocolate bar that had been accidently left in the car earlier. I had bought a stack of large chocolate bars for my Norwex Launch Party on Sunday. I thought I had smuggled them in without Darling 2 seeing them, but one had been left behind in the car.

Ah, the little bit of dark chocolate that we split lifted our spirits and helped to sustain us until we could be "rescued." And then, finally, after 2 hours of lockout, Will did come to save us {mostly from each other}.

An Emergency Kit

This little "disaster" made me think about resources available to me in a real emergency. As noted, I have a small and mostly forgotten about first aid kit in the car. I also have a tackle box in the linen closet with various bandages, ointments, etc. but that's about it.

I have to admit that I have considered stockpiling water, canned foods, packs of tuna, toilet paper, medicine, dog and cat food and the like in case of a true catastrophic event. My brain is paranoid enough for me to imagine the kind of apocalypse that would necessitate such supplies, but my space and pocket book are limited enough to prevent me from actually putting together such a kit.

The List

With that said, I do think it's a good idea to be prepared for anything, especially with the past year of "killer" weather. Floods, hurricanes, tornados, super power storms or even man created emergencies/calamities. So, maybe you don't have to stock 300 cans of green peas and 120 gallons of water and 45 rolls of toilet paper, but a kit with basics isn't a bad idea.

Several government sites suggest that kits include:

1. Prescription medicines and basic over the counter meds, as well as bandages, disinfectants and other first aid necessities;
2. Water {1 gallon per person per day}
3. Flashlight with extra, new batteries;
4. Blanket/sleeping bag per person;
5. Extra water and pet food for pets;
6. Formula, baby food, diapers, etc if there is an infant in your home;
7. Change of clothes for each person {change out for seasons and sizes};
8. Matches in a water proof container;
9. Wrench/pliers for turning off utilities;
10. Battery operated radio/weather radio with extra, new batteries;
11. Toilet paper, baby wipes, trash bags;
12. Non-perishable foods, enough for three days;
13. Local Maps;
14. Dust masks for each person, duct tape, a whistle and utility knife;
15. Cash
16. Important docs like passports, licenses/I.D., birth certificates, etc.;
17. Books, small toys, games, etc. to keep your child(ren) occupied; and
18. In an actual emergency, have keys, cell phone and chargers at the ready.

Resources

Ready.gov has a list of sensible basic items necessary in the event of a threat or disaster. The CDC has a great article and list on its blog about which items to store at the ready and about making an emergency plan for your family to follow if a catastrophe should strike. Personally, I would also add Laptop/Tablet and cord and Chocolate {1 or 2 bars per person per day} to the above list, but that's just me. Let's hope that such a kit is never needed, but if it is then we would all be grateful for being paranoid/prepared enough to have put it together. Or perhaps you all have this kind of kit in your basements already? Maybe we're the only ones completely unprepared for a calamity. Over and out...

The Sign Said to Take a Chance: Well, Here Goes.... {A New Business}

A Chance

The sign said, "Take at Least One." At the bottom of the piece of paper were little tabs to rip off that usually have contact information listed. This one had little tabs with just two words... "A Chance." I don't know who pinned this sign up on the Caribou Coffee bulletin board, but I thought it was clever and it got me to thinking.

Was this a sign I should be paying attention to? Have I taken many risks lately? Am I putting myself out there enough? What's too risky? What's not risky enough? Does it mean I'm not taking risks if I have to ask these questions?

Risky Business    

Honestly, I feel like that the last two years have been one risk after another with the start of launching Motherly Law in March of 2010. I have put myself out there, utterly exposed and vulnerable, in cyberspace and in the tangible space too. I have tried this and that. I have strived to grow as a writer and thinker and doer.

Then, after Will found himself in search of a job, under circumstances not of our choosing, we decided to pursue entrepreneurship and grow a business in social media consulting. Now, recall that I'm an independent contractor for a legal publisher and a freelance writer.

This is no life for the weak. This is a life of no regular paychecks; no benefits of any kind. There is little assurance of anything.

Well, I have decided to take another "chance." I am launching a new business today {in addition to everything we are doing}. I am now......hold onto your hats....this is going to surprise you....a Norwex Independent Sales Consultant. I know, I know; I, myself, am still shocked when I step back and think about this statement. Now, wait, bear with me. Twas the Night Before Christmas: Motherly Law Style

Twas the night before Christmas,

When all thro' the house,

Not a creature was stirring,

Except for the Mom;

The stockings were hung

By the chimney with care,

Full to the brim with Angry Bird pencil toppers, Pez dispensers, chocolate, Squinkies and socks;

The children were nestled all snug in their beds,

While visions of superheroes and pirates danced in their heads,

And Dad in his fleece had just started to snore—

When out on the lawn

There arose such a clatter,

I sprang from my work to see what was the matter.

Away to window I flew like a flash,

Peeked out of the blinds

And checked the triple locked door.

The moon shining down on the brown grass below

Gave no reflection at all;

When, what to my squinting eyes, peering into the darkness, should come into sight

But 8 plastic yard reindeer attached to a broken down sleigh,

With a little, middle-aged driver, so wobbly and slow,

I knew in a moment he must be drunk.

More rapid than eagles these reindeer were not.

And he whistled, and shouted, and call'd them by name:

"Now! Jack {Daniels}, now! Jim {Beam}, now! Jose {Quervo}, and Crown,

On! Bailey{'s}, on! Bud {weiser}, on! Malibu and Captain {Morgan}"

"To the top of the porch! To the top of the wall!

As dry leaves before a wild hurricane fly,

When they meet with an obstacle...really, what does this line have to do with Christmas?

Regardless, up to the house-top those coursers did not try;

With a tired old sleigh and a tipsy St. Nick, those plastic reindeer didn't move an inch.

And then in a twinkling I heard on the window pane

The tapping and rapping and prying and tugging and struggling of that drunk Santa.

As I stood against a wall in the shadows, and reached for my Smartphone from the pocket of my flannel pajamas,

That fake Santa opened the window and climbed in with much difficulty:

He was dress'd all in synthetics,

from his head to his foot,

And his clothes were all tarnish'd

With chili cheese fries and root beer {say it like a Minnesotan and root rhymes with foot, kind of};

An empty bag he had flung over his back,

And he reminded me of...well, the Grinch

Just opening his {empty} sack:

His eyes – oh, how bleary!

His dimples very un-merry and really more like scowls,

Now, his cheeks were like roses

And his nose like a cherry {because of the liquor};

His droll little mouth was

Drawn down in a frown.

And the beard of his chin

Was as red as the nose on a clown;

The stump of a pipe he held tight in his teeth

And the smoke was thick and stinky,

Messing up my freshly cleaned house.

He had a broad face, and a

Big round belly

That bumped into my treasures and trinkets as he tread across my floor;

He was chubby and plump,

A right sad old elf,

And I dialed 911 when I saw him

In spite of my staring

A droop of his hand and nod of his head

Soon gave me to know I had nothing to dread.

He spoke not a word, but

Went straight to sleep.

As he sank into my couch in his filthy old suit,

He turned on his side and began to saw logs.

Giving a nod {to the police} as they arrived at my home,

Out he was dragged before

He could awaken and make haste out the door to escape.

Once revived by fresh air, he sprung into action,

To his team {of plastic reindeer} gave a whistle,

But alas, to no avail, those old yard decorations gave no heed,

And away the cops took him, as fast as they'd descended upon

My humble abode,

But I heard him exclaim, ere he drove out of sight-

Merry Christmas to you, and I'm not the real Claus, just an imposter.

Well, I'll have you know that fake Santa was booked, jailed and bailed,

Then charged, put on trial and convicted

Of the theft of 8 plastic yard reindeer and one antique miniature sleigh,

Disorderly conduct {based on his action at the bar prior to the theft of holiday decor},

And breaking and entering of a residence,

For which he received quite generous sentence in exchange for the promise

That that red-bearded elf would never play Santa again.

And, the red and white Santa Claus suit?

He swears it came in the mail,

Addressed to K. Kringle at his address penned beneath.

He donned it for a lark, but liked its affect

And wore it out for the night of pre-Christmas delight.

Alas, his folly got bold and he landed in prison, abject.

Straight Shooting: Boys & Guns

It's Inevitable

When I gather with other mothers the topic is bound to come up. It started when my sons were just little tikes, probably around the two year mark. And just as the discussion among moms is inevitable so is a boy's desire to know more...no matter how you, as a parent, feel about it.

I'm talking about guns; space blasters, water squirters, Nerf guns, laser guns, pop guns, rifles, pistols and any other kind of toy firearm. There comes a time for just about every boy when guns are of the utmost interest. It seems to be innate. It isn't something that can be contained or dismissed by a parent who wishes to suppress the issue of firearms, whether toy or real. It just happens.

This is not to say that a boy who puts a toy gun on his Christmas wish list will grow up to be a gun slingin', always packin', proud card carryin' NRA member. No, for most it's just a fad as are so many types of toys.

Not to be Ignored

My theory is this, the more you try to ignore the subject of guns, the more your son will want to know about what he's missing out on, which will only perpetuate the gun phase. Boys who are not allowed to play with actual toy guns will build them with Legos or other connecting blocks, turn sticks into guns or simply use their hands. We have allowed the toys guns, but the boys have only a few guns, mostly of the space alien laser type.

We are not gun toting kind of people, as I mentioned in yesterday's post, but I do talk openly about guns. I have explained about the dangers of guns, what to do if they ever encounter a gun in a field, at a person's home, at school, at the park, etc. I have said if they do happen upon a gun that they should never pick it up; even if it looks like a toy because many times real guns might look like a toy gun. Instead, I have instructed them to immediately report to a trusted adult. And I have made it a practice to inquire whether there are guns in the home where my child is invited to play.

The Presence of Firearms

Many people do own guns; some for protection, some for hunting and some for work {as in the case of law enforcement, not bounty hunters and assassins}. And to each his own; as long as the gun is not used or kept in a reckless manner and is obtained and registered legally.

Recently, while at a park with my Darling Boys and one of Darling 1's new friends from Kindergarten, the friend's mom and I had a conversation. Eventually, it turned to boys and guns. I mentioned that we don't have any guns in the home and she told me that they don't have guns either. Then, she said that she had been wondering how she would bring this issue up with parents of new friends from school who might invite her son over, and she was relieved that we had gotten that out of the way.

It's an awkward conversation to have, especially with fellow parents you may have just met, but I made a decision a while ago that I would ask. It's far less awkward to have this conversation than the conversation where you have to tell the parents that their child was accidentally shot and killed by a gun in your home. Sounds harsh, but it's true.

Just think of the number of times you have seen a headline telling of tragedy involving young kids and guns found in the home. Often, the child who lives in the home isn't even aware that a gun is in the home until he or she accidentally finds the gun. These accounts usually have the same storyline; a child finds the loaded gun in a closet, in a table next to the bed, between the mattress, etc. and by accident pulls the trigger shooting either him/herself, an unsuspecting sibling or friend.

You Should....

So, my opinion is that if you do indeed have guns for any purpose in your home, you should tell your children and anyone else in the home that there are firearms present. You should talk to the inhabitants of your home about the dangers of firearms. You should keep the firearms unloaded and locked. You should make sure that the inhabitants of the home know where the firearms are kept, and that location should not be accessible to children. This means it should be locked; kids can climb and reach anything.

Legal Tails: Laws Protecting Animals and People

A Fear of Dogs

Years ago when living in Iowa, I remember being at a friend's home for a small gathering of new acquaintances. These friends had two dogs, one of which was at least part Pit-Bull Terrier if not full-blooded, and also one of the sweetest dogs you might encounter. I recall another friend there who it quickly became apparent was terrified of dogs. My friends apologized for having theirs out and put them in the basement away from the party.

The terrorized friend then related her story of being attacked by a friend's dog years earlier. This dog had never attacked anyone before, but had lunged at her, and she was severely injured and taken to the hospital. Her physical scars had healed, but her mental scars will probably never go away. If this had happened to me, I would probably have different feelings about dogs. When I see a dog that is powerful and intense, I think of her story.

In Reference to Yesterday's Post {It's easier if you just go read it: Animal House}

In yesterday's post I gave you a detailed account of my crazy chaotic household full of cats, dogs and kids. You now know how I feel about animals in general {I love them...in case you missed yesterday's article} and you know that my pets and kids mix and mingle and all equally share the home with us.

Yesterday I also shared two examples of when the mix of pets and kids goes awry with very disturbing facts and endings. A reader alerted me to another similar tragic incident that occurred just a few days prior to the 2 week baby being mauled by the family dog in Houston. This story comes from North Carolina. Five dogs were taken away after one or more of them attacked and killed a 9 day old baby girl. Among these dogs there is at least one Rottweiler and one Pit Bull Terrier. The authorities are also investigating that incident to determine whether criminal charges should be issued or whether this was simply a horrible tragedy.

These news stories are frightening and might be enough for some people to rush to conclusions about parenting styles or about having pets at all if kids are in the house. These stories are not meant to scare or threaten anyone. There are many wonderful reasons to expose kids to pets. They are simply a reminder that pets are animals and can be unpredictable at times. If we make sensible choices and err on the side of caution then most situations can be avoided.

It's important to realize there's a lot we don't know about the dog mauling cases: we don't know whether the dog(s) had been introduced to the infant through smells, etc., whether the parents knew or should have known reasons to keep the dog(s) and baby separated, whether the parents were negligent in failing to keep the two separated and whether the parents were diligent in their care of their infants. The investigations of these two terribly sad incidents will determine the answers to these and other questions in deciding whether to charge anyone with a crime. Regardless of any of these facts, two families have lost their tiny, innocent, brand new babies, and I doubt anything else matters to them at this time.

It's also important to note that none of the dogs have been sentenced to death at this point which probably indicates that none of the dogs have had any run-ins with the law before; meaning no previous reports of biting, etc., up-to-date vaccination records and current licenses. Once the investigations have ended, the fate of these dogs will also be determined. {By the way, the python from yesterday's scenario was spared and is in the custody of the state now. Given the fact that she was being starved to death by her owners having not been fed for over a month and was severely underweight she was not blamed for this death.}

Protecting Your Household and Others

These are things you should know already, but let this serve as a reminder. Again, we sometimes forget these basic requirements of pet ownership. In order to protect your pets, yourself and others, you must keep your pets' vaccines current, renew licenses and keep your pet in its cage, inside a fence, on a leash or whatever enclosure is appropriate for your pet.

If you don't have an umbrella insurance policy, you might look into getting one that would cover the defense and damages of an incident involving your pet and another outside of your household {Check with policy/insurance agent for details regarding coverage.}

It's also important to be familiar with the local, state and federal laws that apply to you and your pet, depending on the type of pet you have. Laws regulating pets are centered on three basic principles: public safety, public health and animal welfare. That is to say, it's the intent of the authorities to protect the public against brutal and often fatal attacks of the owner, members of the household or a member of the public; prevent the spread of diseases, often diseases that are not native to the U.S. or animals here; and put a stop to animal neglect and animal cruelty, which so very often occurs with exotic pet reserves, horse farms or puppy mills.

Local Laws

For the most part, if you have only domestic pets, rather than exotic pets, local ordinances basically provide for licensure and leash requirements and may limit numbers and size of animals, etc. Licensing will ensure that pets are being regularly vaccinated for rabies and any other required vaccines. Licensing also aids in tracking and identifying missing or found pets.

If you are new to a city or a new pet owner or both, be sure to check your local ordinances regarding pets.

Exotic Pets and Laws

If you have exotic pets, there are many other laws and regulations that will apply to you on local, state and federal levels. The definition of exotic pets varies from state to state. So, if you have any question whatsoever as to whether your pet is "exotic" and whether there are laws that apply to your pet, check your area's ordinances, statutes and regulations on all levels.

State Laws

Due to the level of concern over attacks by animals and animal neglect by the owners, more states have passed laws banning certain types of animals in the last decade or so. If you are considering getting an exotic pet, which this term can include some reptiles, fish and birds that may not seem exotic to you, be sure to check the law prior to getting your new pet. Federal Laws

Animal House: Legal Issues and the Family Pet Part I

For the Love of Animals

On most days it's a regular zoo around here. My two Darlings Boys are loud and boisterous alright and sometimes pretend to be monkeys named George or lions or dinosaurs or even Clifford the Big Red Dog and his friends, but we also have two real giant dogs and 3 aging cats. The cats came first starting back in college, then the dogs and finally the kids. Each new addition has been an adjustment for the beings already residing in our household, and each has done beautifully.

I have always been an animal lover. There are very few animals I don't have some kind of affinity for. I talk to all animals, no matter the genus, breed or size as if they are 10 pound floppy, warm, cuddly, sweet, yellow lab puppies. I have never been able to read Call of the Wild or Black Beauty. I hate animal cruelty and cannot take it. I will step in to stop abuse to an animal if I see it happening.

DH loves our animals and has grown to be an animal lover after 17 years with me. His family members are pets belong outside and never in the house and absolutely not on your bed and pets are pets and nothing more kind of people. It's more of a farming community view and is quite a common view of pets.

My family is crazy about animals. In my entire life there have been only two years that I lived without an animal: my freshmen and sophomore years of college. My brother and his wife have 3 dogs and 2 cats. We are animal people. My Darlings seem to be following suit.

Our House

My kids are constantly monitored by our Leonberger who greets them with a lick to their heads upon each return home, as if mentally checking off that the boys are once again safe and sound and under her guard. She adores us all, but she is particularly protective of the boys. It drives her mad if the boys are in the front yard without her, especially if Darling 2, her baby, is darting about and in her opinion too close to the street. She watches from the front window her head going back and forth as they traverse the yard playing soccer or tag or baseball; and she eventually talks me into letting her outside on her leash so that she can be near them.

My boys learned to pull-up and cruise on our Saint Bernard. I am convinced there has never been and will never be a sweeter, more gentle animal on this earth. He is quite large and in his prime weighed 160 pounds. When the boys were babies, he would patiently lay in the living room while the baby grasped two handfuls of his thick coat and held on, laughing and babbling all along. He carefully sidestepped toys, baby gear and the boys themselves. He ignored their crying, loud singing and crashing and bashing of cars and other toys.

Now the cats, being cats, pretty much avoid the boys as much as possible, especially the older they get and the more rambunctious they become. And yet, they have completely accepted the boys (and the dogs). The oldest of all is the most social with them. After all, he's had to adjust to a lot in his 16 years.

Recent Headlines

With that said, I also hate to see tragic headlines about a dog attacking a baby or a pet tiger attacking its owner or a visitor or a monkey getting away from its owner or a python escaping and killing a child.

    Exotic Pets

It seems that exotic pet incidences have been on the rise, which could be indicative of the increase of exotic pet ownership. One such horrible story recently had its final day in court when a young mom, Jaren Hare and her boyfriend were sentenced to 12 years of prison each, after Hare's two year-old daughter, Shaiunna, was strangled to death in her crib by the family's pet python in the summer of 2009.

The snake, Gypsy, an 8.5 foot albino Burmese python, was poorly housed in a makeshift cage in the family's living room. Gypsy had escaped several times. In fact, on the night of the little girl's death, the snake had been found in the hallway of the home. The next morning they found the snake wound around Shaiunna's head in her crib.

The snake had not been fed in over a month and was severely underweight. Apparently, Gypsy had slithered past two other children sleeping in the living room and down the hall to the toddler's room.

The couple were found guilty of manslaughter. The snake had escaped the poorly constructed cage 1o times in the previous two months. The aquarium was covered by a quilt and fastened to the sides with safety pins.

    Domestic Pets

Just last week I saw a gut-wrenching headline about the family dog mauling a tw0-week old infant to death. The baby was sitting in his infant seat in a room in the family home. The mom was keeping an eye on her baby through a window while she was outside. The family dog, a 100 pound Labrador mix, was in another room separated by double French-style doors.

Apparently, the dog pushed its way through the doors into the room where the baby was. The dog began sniffing the infant and then lunged at the helpless baby mauling him before anyone could pull him back. The baby died about 5 hours later after being airlifted to a hospital.

The dog was quarantined by animal control. There was no history of violence from this dog. Animal control has not decided what will happen to the dog. The incident is under investigation to see if there was any negligence on the part of the parents or purely a tragic accident.

The Scoop

The problem is that you don't know how a particular animal might react to a baby, a child or any stranger, regardless of size or age. I know I have been surprised a few times by my animals by the way they have reacted to a particular situation, not necessarily in a negative way and not necessarily involving kids, but nonetheless surprised.

We certainly weren't going to get rid of our pets when he had kids, but we did follow a few guidelines. When I returned home from the hospital after giving birth I greeted the animals alone. Prior to coming home with our baby, DH had brought home and offered for sniffing a blanket and piece of clothing that was used by the baby. Then, we slowly introduced the animals to the baby with one of us holding the baby and the other holding onto the pet. We never left the animals alone with kids when they were babies and we always closed the baby's room door. We had no issues at all.

This is not to say that all results would be the same if another person with other pets took all of these precautions. I think you do have to think about it in advance, prepare for having kids and pets and then be cautious and never just assume your gentle loving pet is OK with kids. Your Liability: Inflatable Bounce Houses

Torts

Negligence is defined as "the failure to exercise the standard of care that a reasonably prudent person would have exercised in a similar situation; any conduct that falls below the legal standard established to protect others against unreasonable risk of harm. Source: Black's Law Dictionary, 9^th Ed.

Now this takes me back to my 1^st semester of law school; Torts class with Professor Peter B Kutner. No, I don't mean the pastry kind of tortes. A tort is quite simply a civil wrong; a breach of duty owed to another. Torts are a big part of the first year of law school; one of the basic building blocks of law. Negligence is a tort.

When one is negligent in action {or inaction, as the case may be} and causes an injury to a person or property, one is liable to the one sustaining such injury. This is all simply put, and of course, each case is unique in circumstances, etc., but in general it's that simple.

What determines whether someone was negligent in a situation is the illusory reasonable person. The reasonable person is a hypothetical person used as a legal standard to determine whether someone acted in a negligent manner. The reasonable person acts sensibly, does things without serious delay and takes proper but not excessive precautions. Source: Black's Law Dictionary.

In my 1L {First Year of Law School} section we playfully imagined the prudent "Reasonable Person" as a super hero of sorts with a cape and a giant R on his chest running around doing sensible things. But in truth, the reasonable person is not mightier, smarter or better than everyone else, just always alert, always aware and always doing the "reasonable" thing in any given situation.

Liability Issues

When it comes to bounce house injuries and liability there is no sure answer as to whether someone would be liable if a person was injured in conjunction with the bounce house activity while attending a party at your home; or if a person was injured by you or your child while jumping in a bounce house elsewhere; or if you or a family member was injured at a bounce house business or at a private party, etc. Each case is unique and if a lawsuit was filed following an injury that case would be decided in a court of law based on the particular facts as applied to the law.

With that said, here are a few tips when it comes to negligence and liability and bounce houses:

• If you sign a waiver, you are accepting the risk associated with the activity itself, but you are NOT accepting the risk associated with a negligent act on the part of the business or someone associated with that business. You can still file a lawsuit if you are injured due to negligent maintenance, set up or management, etc. of the bounce houses, regardless of whether you signed a waiver;
• If a risk of danger or injury is obvious or should be obvious to a person using the premises and an injury occurs, that is generally not considered negligence;
• If an injury occurs in or around a bounce house, liability may lie with the operator of the bounce house, owner of the structure and/or business where it's located, the manufacturer and/or other jumpers or invitees, depending on the particular circumstances;
• If you rent a bounce house for your home, business or event do be sure to follow all rules provided to you and use reasonable caution in operating and monitoring the bounce house. If you follow all rules and closely monitor the usage of it while on your property and under your care, you will decrease the chance of injury and the chance that you are liable for any injuries;
• You should check to see if the operator or owner of the bounce house has insurance covering injuries. Also, if you are inviting people to your house to use a rented bounce house, check with your own insurance company covering your property. • As a parent, it's your duty to protect your child. If you see something that seems dangerous feel that the structure is in ill repair or the operator is being unsafe or not monitoring the use of the structure, use reasonable judgment and remove your child from the bounce house; avoid injury, if possible; and
• Remember accidents do happen; not every injury is due to someone else's negligence.

The Scoop

So, in the end it's up to you to decide when it's safe and when it's not safe for your child to play in and around a bounce house. Many people have left comments here, on Twitter or on Facebook this week saying that they were just at a bounce house or are attending a party this week at a bounce structure business, etc. It's would be hard to avoid them altogether. They are at schools, at churches, almost all children's events have them and many birthday parties, large family gatherings and business activities for employees and families rent them.

Bounce structures are everywhere. The number of injuries sustained involving bounce houses continues to grow with their popularity. Is it simply a trend? Will bounce houses begin to go away, especially after the negative news stories of late involving injuries and catastrophe? We'll see, but for now, follow the rules, watch for unsafe conditions and monitor the situation while your kids are in the bounce structure. Over and out...

A Passion for Consumer Safety: Safety Tips for Bounce House Jumping

Making it Personal

I recently had a conversation with a friend who also authors a blog. In discussing a new endeavor she made the statement that my new project would be more personal than Motherly Law. I didn't argue this point with her and brushed it aside at the time. Later I thought about this statement again. I know that she meant nothing by it, but it really bothered me. I think Motherly Law is quite personal, actually.

I could never sell Motherly Law or pass it off to someone else. Motherly Law is unabashedly me. Motherly Law posts contain my heart and soul. I write what I am passionate about.

Motherly Law is not a stiff "just the facts, ma'am" kind of place. This is a place with enthusiasm for the law; a place with ardor for informing parents; a place with eagerness to connect with other moms; and a place with loads of emotion concerning all of these things.

Consumer Safety & Bounce Houses

One of the things that I am quite passionate about and I take quite personally is consumer safety and kids. As I mentioned on Monday and as every parent knows, kids love to jump and bounce on any surface they can. Bounce houses have become the norm for kid activities everywhere. These structures are fun and seem as safe if not safer than most equipment on the playground.

The problem is they can be quite dangerous depending on the set up, the weather conditions and the number, ages and sizes of kids. In 2004, there were 4,900 injuries reported. Numerous deaths have been reported of young children, teenagers and adults. One orthopedic surgeon in Texas reports that he treats people with bounce house injuries 5 to 10 times a month, many requiring surgery.

Safety Tips

If you're still OK with allowing your kids to frequent a bounce house after that last paragraph, then try to implement these tips to make the bounce house experience safer:

1. Make sure the bounce house is securely staked to the ground and weighted down;
2. If it's windy or there's other inclement weather, keep everyone out of the bounce structure. Some inflatable should be taken down at 15 mph gusts and others can withstand 25 mph gusts; that's not much;
3. Check for an inspection sticker. Not all states require an inspection; in fact, only 19 require it. But if an inflatable structure has an inspection sticker you know that the operator is complying with the state law or has gone the extra mile to ensure the structures are safe;
4. Be sure to have age limits as to who can jump together at one time; just 2 and 3 year-olds and then 4, 5 and 6 year-olds, etc. This can be more difficult when out in public in a bounce structure that is not monitored, but you can self regulate a bit when it comes to when your kids can jump;
5. Watch your kids. Many parents think it's a safe place for kids to be and wander off to chat with friends at a party, etc. and don't watch who is jumping and what's happening in the bounce house; if it's a backyard party, make sure there is a one adult monitoring at the door at all times;
6. Read the rules posted outside of a bounce house; if there are rules. This way your children will be reminded of appropriate behavior in the bounce house each time they play there; and
7. Lastly, a reminder from yesterday's post; always have your kids wash hands and face after jumping to be sure to wash away any lead dust from the vinyl of the bounce structure.

Ready, Set, Jump: Bouncy House Safety

The Joy of Bouncing

What is it about jumping that brings such joy to kids? When Darling 1 was just a few weeks old he starting bouncing in my lap; he loved to bounce, bounce, bounce. Darling 1 was such a bouncer that we bought him a Tigger Halloween costume when he was 3 months old. Both the Boys still love to bounce whether it's at Skyzone on a trampoline, on a bed at home, or in a bouncy house.

Nearly every mid to large size town now has a inflatable bounce structure business that's all about jumping, climbing and sliding. These are prime birthday party locations; great indoor play areas when the weather is foul; and fun for the whole family. These structures have made appearances in thousands of yards for all kinds of celebrations; they're present at fairs, festivals and carnivals; and a sure thing at church events and school activities.

Safe Jumping

So, what's the big deal? It's fun to jump; the surfaces aren't hard or sharp; and the kids are safe, right? The answer is tricky. Lately, the seemingly innocent and fun bouncy structures have been getting a lot of bad press. A preliminary search quickly found these incidents: a gust of wind has picked up a bouncy house and flung it into a roof or several yards over or straight up in the air; kids summersault or fall or jump into each other; kids knock into people standing outside the bouncy structure; and kids are exposed to lead in the plastic of the bouncy house. In each of these accidents, people were killed or injured, some were catastrophic injuries.

A Collapsing Bouncy House

This past weekend, we attended a fun end of the summer party in the backyards of our friends and their neighbors who live behind them. Partygoers wandered back and forth. There was live music in one yard, food in one of the houses, drinks at both houses, and a bouncy house in one yard. The Boys immediately gravitated to the spectacular, Toy Story themed, giant bouncy structure. There was a slide, a basketball hoop and several "rooms" for jumping. We finally cajoled them to get out to come eat.

Later, when it was dark, they asked to go back to the bouncy house in the other yard. DH went with them and about 10 minutes later, I walked over to check on them. When I got past the shrubs that divide the yard, I heard Darling 2 crying and saw DH crawling in to find him. At that same time, I noticed the spotlight that had been trained on the bouncy house went out, along with other outside lights. I went around to the side where Darling 2 was to check that he was OK and with DH.

It was then I noticed the bouncy house was deflating... and quickly. Then, it dawned on me, the breaker had flipped with the bouncy house compressor, spotlight and outdoor lights all on; it was too much for the breaker. By this point, the kids were screaming because they realized it was coming down. I yelled to the people standing by the house to flip the breaker and get a flashlight. Since DH was in the bouncy house, he was able to grab our Boys and corral the rest of the kids and get out. He told me the kids were having a hard time trying to get out because the top was falling on them and the deflating floor had big sink holes and gaps in it and it was totally dark.

All the kids did get out {as well as DH}. No one was injured. But that was enough excitement for us. We were done with the bouncy house. And it made me start thinking about bouncy house safety. I had heard a few stories of the structures taking flight after a big gust of wind or on a windy day, but with just a little digging I found a lot more.

This week I'm going to be discussing the various dangers, liability issues and rules for staying safe when it comes to inflatable bouncy structures. Should you boycott them altogether? Well, that's up to you, but I know that I will for sure never rent one for my yard, and I will think twice before allowing my kids to jump in one. I'll be back with more tomorrow. Over and out...
